Extension of Projects
The Promoter / Developer at the time of registration of a real estate project is required to submit a Declaration stating the date of completion of the project i.e., the date on which the construction of the real estate project is proposed to be completed. If the Promoter/Developer fails to complete the real estate project within the time mentioned in the Declaration then, the Promoter/Developer shall make an application to the Authority in the form as prescribed under RERA, stating the reasons for grant of extension of the real estate project in brief. If the Authority is satisfied with the reasons mentioned by the Promoter / Developer, then the Authority may grant the extension of the real estate project at its discretion and in any reasonable circumstances and record the reasons for the same. However, such reasonable circumstances shall not be due to any default on the part of the Promoter / Developer. The Authority may reject the application for extension if not satisfied with the reasons stated by the Promoter / Developer.
The extension of a real estate project can be obtained under Section 6 of RERA for delay due to ‘force majure’ reasons for upto a year. In case the Promoter / Developer fails to complete the real estate project even within extended period then in such case further extension may be granted making an application to the authority under section 7(3) of RERA and in the form as prescribed under RERA stating the reasons for extension. In such case the Promoter / Developer is required to obtain 2 / 3rd consent of the allottees of the real estate project. That only after obtaining required consent and payment of fees prescribed under RERA and on satisfaction of the Authority with the reasons mentioned by the Promoter / Developer, the Authority may grant further extension for completion of the real estate project.
